The term ‘you’ refers to the user or viewer of our website or a participant in one of the trips conducted by us.

For Travellers and Trip Participants:

Health and Fitness Requirements

Travellers and Participants on a trip or trek conducted by Eka must be in good health and reasonable physical condition. It is vital that participants with medical problems make them known to us well before departure. All medical expenses will be the responsibility of the participant. Furthermore, post-booking of a trip with us and before the trip departure, all participants of that trip must certify on a release of liability and assumption of risk agreement.

Travel Insurance

Personal travel insurance is not included in the tour price. We strongly recommend that you take out travel insurance including cancellation insurance upon booking, especially for trips that may involve High altitude trekking for example our Gokyo-Everest Base Camp Trek in Nepal. Eka Experiences may require that a policy is held prior to departure. We will accept no liability for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside our control.

Cancellation & Refund Policy:

1. If it becomes necessary to cancel your trip booking with Eka, you must notify us immediately in writing. Once we receive your notice, cancellation will take effect. Please note that the following standard charges will apply on cancellation:

• If participant cancellation takes place more than 30 days prior to trip departure: 20% of the total trip cost will be forfeited
• If participant cancellation takes place between 30 days & 7 days prior to trip departure : 40% of the total trip cost will be forfeited
• If participant cancellation takes place less than 7 days prior to departure : 100% of the trip cost/deposit will be forfeited
• In case the balance amount remains unpaid by due date, the trip will be deemed cancelled and above cancellation policy will be applicable
• Cancellation charges may vary for certain trips and treks. Before the trip, you will be informed of the charges that apply

2. Cancellation of a trip by Eka : Eka Experiences reserves the right to cancel any trip or a booking in which case participants will be given a refund in full. If cancellation is due to Covid-related lockdown, restrictions or destination closures, 100% booking/trip cost will be refunded However, you will not be entitled to make any further claim for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

3. In the event of cancellation or alteration of a trip by us before departure due to unavoidable circumstances and events including war, pandemic, strikes, curfews, civil strifes, riots, terrorist activities, natural disasters, transport issues, and events amounting to force majeure, then if possible we will offer alternative options for your already booked trip. If alternatives are not possible, In the event of complete trip cancellations by us, ‘Eka Travel
Vouchers’ will be provided to all participants of the trip (equal to the trip cost amount). The vouchers can be utilized against the same trip or any of our scheduled trips at a later date and will come with unlimited validity.

4. No refunds unfortunately will be made for no show, missed, partially utilized or unutilized services.

Acceptance of Risk:

You acknowledge that our tours and treks may involve some risk to your health and safety. The degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates. There may be a significant degree of personal risk involved in participating in physical and/or high-risk activities or traveling to high altitudes, remote locations, or places with developing infrastructure.

Please note that your health is entirely your risk and responsibility. Our tours are suitable for persons of reasonable fitness. They may not suit persons who are medically infirm or who have special needs or requirements whether due to age, medical conditions or otherwise. It shall be your duty to inform us in writing in case you have any medical condition that may affect your ability to fully enjoy our tour arrangements or where the interests of other tour participants may be adversely affected by such condition. We reserve the right (with out obligation) to ask you to undergo medical tests and to provide written certification of your medical fitness before departure or at any time during the tour and if you fail to under go such tests or fail to provide such certificates, we may decline to accept you or to continue you on the tour. Our actions in this regard may be guided not only by concerns for your health but also the convenience and health of the other tour participants. However, it is not our obligation to check your medical condition and if you suffer any injury or aggravation on the tour or if you are unable to enjoy / complete the whole or any part of the tour due to your medical conditions, we shall not be liable to compensate you nor to refund any amount to you nor to pay your medical expenses. 

By booking with us, you acknowledge that you have considered the potential risks, dangers and challenges, and your own personal capabilities and needs, and you assume responsibility for all such risks. You agree to take all prudent measures in relation to your own safety while traveling, including but not limited to the proper use of safety devices (like seatbelts, helmets etc.) and obeying all posted signs and oral or written warnings regarding health and safety. Eka tours and travels’ employees, team members or any representatives will not be held liable for any claims or causes of action arising from any losses, damages, injuries, or death resulting from failure to comply with safety instructions, safety briefings or warnings or the risks inherent in travel and participating in adventurous activities included in our itineraries or otherwise offered by us or our representatives.

Image rights on tours and treks conducted by Eka

Eka Tours and Travels reserves the right to take photos of all trip participants and guests. These images may be used for promotional purposes of our upcoming tours. By booking any trip with us, you automatically grant us permissions for using your images in promotional, marketing or any publicity materials. Should you have any reservations about your images being used for such purposes, please inform us at the time of booking your trip.

Right of Removal

Eka Experiences reserves the right to withdraw trip membership from anyone whose behavior is deemed likely to affect the smooth operation of the tour or adversely affect the enjoyment and personal safety of other participants. Eka shall be under no liability to any such person.

Applicable law

These Terms and conditions and agreements shall be interpreted and subject to the laws of the Republic of India. All disputes, suits or legal proceedings of any nature arising under the terms of this agreement/booking form shall be instituted within the territory of Republic of India only.
